1. Acceptance of Terms
By accessing or using the SureShift platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree to these Terms, you must not use the Service.
2. Service Description
SureShift is a cloud-based, progressive web application (PWA) for workforce shift verification and task management. The Service enables organisations to manage employee check-ins via GPS verification, assign and track tasks, and collect proof of task completion through QR scanning and photo capture.
The Service is provided on a software-as-a-service (SaaS) basis. We reserve the right to modify, update, or discontinue features of the Service at any time with reasonable notice.
3. User Obligations
As a user of the Service, you agree to:
- Provide accurate and complete registration information.
- Maintain the confidentiality of your account credentials.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Not use the Service to store or transmit malicious code or content that infringes intellectual property rights.
- Ensure that all users within your organisation comply with these Terms.
4. Data Ownership & Intellectual Property
You retain ownership of all data you submit to the Service ("Customer Data"). By using the Service, you grant SureShift a limited licence to process Customer Data solely for the purpose of providing the Service.
SureShift and its licensors retain all rights, title, and interest in the Service, including all intellectual property rights. These Terms do not grant you any rights to use SureShift's trademarks, logos, or branding.
5. Limitation of Liability
To the maximum extent permitted by applicable law, SureShift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Service.
- Any unauthorised access to or alteration of your data.
- Any interruption or cessation of the Service.
Our total aggregate liability arising out of these Terms shall not exceed the amounts paid by you to SureShift in the twelve (12) months preceding the event giving rise to the claim.
6. Termination
Either party may terminate these Terms at any time by providing written notice. Upon termination:
- Your right to access the Service will cease immediately.
- You may request an export of your Customer Data within 30 days of termination.
- After 30 days, all Customer Data will be permanently deleted.
SureShift may suspend or terminate your access immediately if you breach these Terms or if continued use poses a security risk.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
